Article 36 of the Administrative Control Authority Law

كل عضو يخرج على مقتضى الواجب فى أعمال وظيفته
أو يظهر بمظهر يخل بشرف الوظيفة يعاقب تأديبيا وذلك مع عدم الإخلال
بإقامة الدعوى المدنية أو الجنائية عند الاقتضاء ، ولا يعفى العضو من
العقوبة استنادا إلى أمر رئيسه إلا إذا أثبت أن ارتكابه المخالفة
كان تنفيذا لأمر مكتوب بذلك صادر إليه من هذا الرئيس بالرغم
من تنبيهه كتابة إلى المخالفة وفى هذه الحالة تكون المسئولية على
مصدر الأمر .
