فى تنفيذ أحكام هذا الباب يعتبر حائزا كل مالك أو مستأجر يزرع أرضا زراعية لحسابه أو يستغلها بأى وجه من الوجوه وفى حالة الإيجار بالمزارعة يعتبر مالك الأرض حائزا مالم يتفق الطرفان كتابة فى العقد على إثبات الحيازة باسم المستأجر و يعتبر فى حكم الحائز أيضا مربى الماشية ، وتسرى عليه أحكام هذا الباب .
