تقوم وزارة التعليم العالى ببحث طلب الترخيص للتحقق من الآتى:
( أ ) مدى ملاءمة أهداف التعليم بالمعهد للأهداف العامة للدولة.
(ب) مدى ملاءمة إنشاء المعهد المطلوب الترخيص به لسد احتياجات معينة من المستوى المحدد لخريجيه.
(ج) مدى ملاءمة خطة ومناهج الدراسة لتحقيق أهداف التعليم بالمعهد.
وعلى الوزارة أن تبلغ طالب الترخيص، وذلك بكتاب موصى عليه بعلم الوصول، قرارها بقبول الطلب أو رفضه خلال تسعين يوما على الأكثر من تاريخ تقديمه.
