يتولى أعضاء هيئة التدريس ومعاونوهم اختيار شاغلى الوظائف القيادية المنصوص عليها بهذا القانون (رئيس مجلس القسم - عميد الكلية أو المعهد - رئيس الجامعة)، وذلك بطريق الانتخاب وفقا للشروط والإجراءات ومعايير المفاضلة التى يقرها المجلس الأعلى للجامعات بمشاركة ثلاثة من رؤساء نوادى أعضاء هيئة التدريس على نحو يضمن كفالة المساواة والعدالة بين جميع المتقدمين لشغل هذه الوظائف وتحقيق اختيار أفضل وأكفأ العناصر الممثلة لإرادة أعضاء هيئة التدريس بالجامعات ويصدر قرار التعيين من السلطة المختصة بالتعيين وفقا لهذا القانون وذلك طبقا لنتيجة الانتخابات ويلغى كل ما يخالف ذلك".
