يعتبر عضو مجلس الدولة مستقيلا إذا انقطع عن عمله
مدة ثلاثين يوما متصلة بدون إذن ولو كان ذلك بعد انتهاء أجازته أو إعارته
أو ندبه لغير عمله .
ومع ذلك إذا عاد العضو وقدم أسبابا تبرر انقطاعه عرضها رئيس مجلس
الدولة على المجلس الأعلى للهيئات القضائية فإن تبين له جديتها اعتبر غير
مستقيل وفى هذه الحالة تحسب مدة الغياب أجازة من نوع الأجازة السابقة
أو أجازة اعتيادية بحسب الأحوال .
