يجوز أن يعين فى وظيفة مستشار :
( ١ ) المستشارون السابقون بمجلس الدولة .
( ب ) المستشارون بمحاكم الاستئناف والمحامون العامون بالنيابة العامة
والوكلاء العامون بالنيابة الإدارية والمستشارون بإدارة قضايا
الحكومة .
( ج ) أساتذة كليات الحقوق وأساتذة القانون بجامعات جمهورية مصر
العربية الذين أمضوا فى وظيفة أستاذ مدة لا تقل عن ثلاث
سنوات .
( د ) المحامون الذين اشتغلوا أمام محكمة النقض خمس سنوات متوالية .
