تشكل الجمعية العمومية لمجلس الدولة من جميع المستشارين
ويتولى رياستها رئيس المجلس وعند غيابه أقدم الحاضرين من نواب
الرئيس ثم من المستشارين .
وتدعى الجمعية العمومية للانعقاد بناء على طلب الرئيس أو خمسة من
أعضائها ، ولا يكون انعقادها صحيحا إلا بحضور الأغلبية المطلقة لأعضائها
وتختص الجمعية العمومية عدا ما هو مبين فى هذا القانون بإصدار اللائحة
الداخلية للمجلس .
