يؤدى القضاة قبل مباشرة وظائفهم اليمين الآتية :
أقسم بالله العظيم أن أحكم بين الناس بالعدل وأن أحترم
القوانين .
ويكون أداء رئيس محكمة النقض اليمين أمام رئيس الجمهورية .
ويكون أداء اليمين بالنسبة لنواب رئيس محكمة النقض ورؤساء محاكم
الاستئناف وتوابهم أمام الجمعية العامة لمحكمة النقض .
ويكون أداء اليمين بالنسبة للمستشارين بمحكمة النقض ومحاكم الاستئناف
أمام إحدى دوائر محكمة النقض أما من عدا هؤلاء من رجال القضاء فيؤدون
اليمين أمام إحدى دوائر محاكم الاستئناف .
