يجوز أن تقام الدعوى التأديبية ضد موظفى المحاكم والنيابات بناء على طلب رئيس المحكمة بالنسبة لموظفى المحاكم و بناء على طلب النائب العام أو رئيس النيابة بالنسبة لموظفى النيابات .
