يشكل مجلس التأديب فى محكمة النقض وفى كل محكمة من محاكم الاستئناف من مستشار تنتخبه الجمعية العامة ومن المحامى العام وكبير كتاب المحكمة .
وفى المحاكم الابتدائية والنيابات من رئيس المحكمة ورئيس النيابة أو من يقوم مقامهما وكبير الكتاب ، ويستبدل كبير المحضرين عند محاكمة أحد المحضرين ورئيس القلم الجنائى عند محاكمة أحد كتاب النيابات .
وفى حالة محاكمة كبير الكتاب وكبير المحضرين أو رئيس القلم الجنائى ينتدب وزير العدل من يحل محله فى مجلس التأديب ممن يكونون فى درجته على الأقل .
