يتولى مجلس الدولة الافتاء فى الموضوعات القانونية المتعلقة بوحدات الحكم المحلى.. كما تتولى ادارة قضايا الحكومة مباشرة الدعاوى التى تكون هذه الوحدات طرفا فيها.
وتتم احالة الموضوعات القانونية المشار اليها من رئيس المجلس الشعبى المحلى للمحافظة أو من المحافظ المختص أو من ينيبه بحسب الأحوال.
