لعضو النقابة ولصاحب العمل حق التظلم من قرار المجلس المختص في العشرة أيام التالية لإعلانه إليه ، وذلك بتكليف خصمه بالحضور أمام المحكمة المختصة .
و يجوز الطعن في الأحكام الصادرة في التظلم بجميع أوجه الطعن العادية وغير العادية ماعدا المعارضة و تتبع في ذلك القواعد المنصوص عليها في قانون المرافعات .
