يقصد بالعاملين بالدولة فى تطبيق أحكام هذا القانون العاملون داخل جمهورية مصر العربية الدائمون والمؤقتون والمعينون بمكافآت شاملة بالجهاز الادارى للدولة أو بوحدات الادارة المحلية أو بالهيئات العامة أو بالمؤسسات العامة أو بشركات القطاع العام أو شركات قطاع الأعمال العام، وكذلك العاملون بالدولة الذين تنظم شئون توظفهم قوانين أو لوائح خاصة وذوو المناصب العامة والربط الثابت.
