إذا رأت النيابة العسكرية أن الواقعة مخالفة أو جنحة عسكرية بسيطة يجوز لها إحالة التحقيق إلى قائد المتهم لمجازاته انضباطيا طبقا للسلطات المخولة له قانونا .
