إذا رأت النيابة العسكرية أن الواقعة لا يعاقب عليها القانون ، أو أن الأدلة على المتهم غير كافية ، تصدر أمرا بأن لا وجه لإقامة الدعوى . ويفرج فى الحال عن المتهم المحبوس إن لم يكن محبوسا لسبب آخر .
ويصدر الأمر بأن لاوجه لإقامة الدعوى فى الجنايات من المدعى العام العسكرى أو من يقوم مقامه .
