يكون التفتيش البحث عن الأشياء الخاصة بالجريمة الجارى جمع الأدلة أو التحقيق بشأنها .
ومع ذلك إذا ظهر عرضا أثناء التفتيش وجود أشياء تعد حيازتها جريمة أو تفيد فى كشف التحقيق عن جريمة أخرى جاز ضبطها .
ولا يخل ذلك بالحق المخول للقادة فى التفتيش على الوحدات والأفراد طبقا للأوامر العسكرية .
