إذا ارتكب ضابط أو ضابط صف إحدى الجرائم الآتية :
١ — استلامه ماهية ضابط أو عسكري وحجزها بطرفه بدون وجه قانوني أو امتناعه عن دفعها لصاحبها وقت استحقاقها بدون وجه قانوني .
٢ — الاقتراض من العساكر .
يعاقب إذا كان ضابطا بالطرد أو بجزاء أقل منه منصوص عليه في هذا القانون . و إذا كان ضابط صف تكون العقوبة الحبس أو جزاء أقل منه منصوص عليه في هذا القانون .
