إذا ارتكب ضابط أو ضابط صف الجريمة الآتية :
ضربه عسكريا أو إساءته معاملته بطريقة أخرى .
يعاقب إذا كان ضابطا بالطرد أو بجزاء أقل منه منصوص عليه في هذا القانون .
و إذا كان ضابط صف تكون العقوبة الحبس أو جزاء أقل منه منصوص عليه في هذا القانون .
