لايقبل التماس إعادة النظر إلا إذا أسس على أحد السببين الآتيين :
١ أن يكون الحكم مبنيا على مخالفة للقانون أو على خطأ فى تطبيقه أو فى تأويله
٢ أن يكون هناك خلل جوهرى فى الإجراءات ترتب عليه إجحاف بحق المتهم .
