لعضو النقابة ولمن صدر ضده أمر التقدير، أن يتظلم منه خلال الثلاثين يوما التالية لوصول إعلان الأمر إليه وذلك بدعوى قضائية ترفع أمام المحكمة المختصة، وفقا لأحكام قانون المرافعات ويختصم فيها مجلس النقابة المختص.
