للنيابة العامة أو للمحكمة المختصة بحسب الأحوال ، بناء على طلب كتابي من الوزير أو رئيس المصلحة بتفويض من الوزير الأمر بوقف المتهم بارتكاب جريمة التهريب الجمركي عن التعامل مع المصلحة لحين صدور حكم نهائي في الدعوى .
كما يوقف التعامل مع كل من يصدر ضده حكم نهائي بالإدانة في إحدى الجرائم المنصوص عليها في هذا القانون إلى أن يتم تنفيذ العقوبة المحكوم بها أو انقضاء الدعوى الجنائية بالتصالح .
