فى حالة وقوع أى فعل من أفعال التهرب من الضريبة من أحد الأشخاص الاعتبارية المنصوص عليها فى القانون الضريبى ، يكون المسئول عنه الشريك المسئول أو المدير أو عضو مجلس الإدارة المنتدب أو رئيس مجلس الإدارة ممن يتولون الإدارة الفعلية ، بحسب الأحوال ، متى ثبت علمه بها وكان إخلاله بالواجبات التى تفرضها عليه تلك الإدارة قد ساهم فى وقوع الجريمة .
