١ - يجوز لدائن الشركة طلب شهر إفلاسها ولو كان شريكا فيها . أما الشركاء
غير الدائنين فلا يجوز لهم بصفتهم الفردية طلب شهر إفلاس الشركة .
٢ - إذا طلب الدائن شهر إفلاس الشركة ، وجب اختصام كافة الشركاء
المتضامنين .
