Article 396 of the Trade Law

١ - يعتبر حائز الكمبيالة حاملها الشرعى إذا أثبت أنه صاحب الحق فيها بسلسلة من تظهيرات غير منقطعة ولو كان آخرها تظهيرا على بياض . وتعتبر التظهيرات المشطوبة فى هذا الشأن كأن لم تكن . وإذا أعقب التظهير على بياض تظهير آخر اعتبر الموقع على هذا التظهير أنه هو الذى آل إليه الحق فى الكمبيالة بالتظهير على بياض .
٢ - إذا فقد شخص حيازة الكمبيالة فلا يلزم الحامل بالتخلى عنها إذا أثبت حقه فيها طبقا للفقرة السابقة إلا إذا كان قد حصل عليها بسوء نية أو ارتكب فى سبيل الحصول عليها خطأ جسيما .
