مع عدم الإخلال بأحكام المادة ( ٣٨٥ ) من هذا القانون ليس لمن أقيمت عليه دعوى بكمبيالة أن يحتج على حاملها بالدفوع المبنية على علاقاته الشخصية بساحبها أو بحامليها السابقين مالم يكن قصد الحامل وقت حصوله عليها الإضرار بالمدين .
