١ - يرجع فى تحديد أهلية الملتزم بموجب الكمبيالة إلى قانون الدولة التى ينتمى إليها بجنسيته .
٢ - وإذا كان القانون الواجب التطبيق يعتبر الملتزم بموجب الكمبيالة ناقص الأهلية فإن التزامه يبقى صحيحا إذا وضع توقيعه على الكمبيالة فى دولة يعتبره قانونها كامل الأهلية .
