١ - من يوقع كمبيالة نيابة عن شخص آخر بغير تفويض منه يلتزم شخصيا بموجب الكمبيالة فإذا أوفاها آلت إليه الحقوق التى كانت تزول إلى من ادعى النيابة عنه .
٢ - ويسرى هذا الحكم على النائب إذا جاوز حدود سلطته .
