إذا أفلس أحد طرفى الحساب الجارى فلا يجوز الاحتجاج على جماعة الدائنين فى تفليسته بأى رهن تقرر على أمواله بعد التاريخ الذى عينته المحكمة للوقوف عن الدفع لضمان دين الرصيد المحتمل ، وذلك فى حدود الرصيد المدين وقت تقرير الرهن ، ويجوز الاحتجاج بالرهن فيما يتعلق بالفرق - إن وجد - بين مقدار هذا الرصيد ومقدار الرصيد الذى يظهر وقت قفل الحساب إلا إذا ثبت علم الدائن وقت تقرير الرهن بتوقف المدين عن الدفع .
