إذا تلف الشىء أو تأخر وصوله بحيث لم يعد صالحا للغرض منه وثبتت مسئولية الناقل
عن التلف أو التأخير ، جاز لطالب التعويض أن يتخلى له عن الشىء مقابل الحصول
على تعويض يقدر على أساس هلاك الشىء كليا .
