١ - لا يضمن الوكيل بالعمولة وفاء الغير المتعاقد معه بالتزامه إلا إذا تحمل هذا الضمان صراحة أو نص عليه القانون أو كان مما يقضى به عرف الجهة التى يمارس فيها نشاطه .
٢ - يستحق الوكيل بالعمولة الضامن أجرا خاصا تحدده المحكمة عند عدم وجود اتفاق أو عرف فى شأنه .
