١ - إذا أفلس الوكيل بالعمولة المكلف بالبيع قبل قبض الثمن من المشترى ، جاز للموكل أن يطالب المشترى مباشرة بأداء الثمن إليه .
٢ - وإذا أفلس الوكيل بالعمولة المكلف بالشراء قبل تسلم المبيع ، جاز للموكل أن يطالب البائع مباشرة بتسليم المبيع إليه .
