١ - يتبع فى التنفيذ على البضائع والأشياء الموجودة فى حيازة الوكيل التجارى إجراءات التنفيذ على الشىء المرهون رهنا تجاريا .
٢ - ومع ذلك إذا كان الوكيل مكلفا ببيع البضائع أو الأشياء التى فى حيازته له جاز له التنفيذ عليها ببيعها دون حاجة إلى اتباع الإجراءات المشار إليها فى الفقرة السابقة إلا إذا تعذر عليه تنفيذ تعليمات الموكل فى شأن البيع .
