١ - يتم رهن الحقوق الثابتة فى الصكوك الاسمية بحوالة يذكر فيها أنها على سبيل الرهن وتقيد فى دفاتر الجهة التى أصدرت الصك .
٢ - ويتم رهن الحقوق الثابتة فى الصكوك لأمر بتظهير يذكر فيه أنه للرهن أو أية عبارة أخرى تفيد ذلك .
٣ - ويكون الرهن المشار إليه فى الفقرتين السابقتين نافذا فى حق المدين دون حاجة إلى إعلانه بالرهن أو قبوله .
