١ - مع مراعاة الأحكام المنصوص عليها فى المادة السابقة لا يشترط لنفاذ الرهن التجارى فى حق الغير أن يكون مكتوبا أو أن تكون الورقة التى يدون فيها الرهن ثابتة التاريخ .
٢ - ويجوز إثبات الرهن التجارى فيما بين المتعاقدين وبالنسبة إلى الغير بكافة طرق الإثبات أيا كانت قيمة الدين المضمون بالرهن .
