إذا تخلف أحد الطرفين عن تنفيذ التزاماته بشأن أحد التوريدات الدورية فلا يجوز للطرف الآخر فسخ العقد إلا إذا كان من شأن التخلف عن التنفيذ إحداث ضرر جسيم له أو إضعاف الثقة فى مقدرة الطرف الذى تخلف عن التنفيذ على الاستمرار فى تنفيذ التوريدات اللاحقة بصورة منتظمة .
