١ - إذا رفض المشترى تسلم المبيع جاز للبائع بعد إثبات حالة المبيع أن يطلب بأمر
على عريضة من القاضى المختص الإذن فى بيعه بعد انقضاء مدة يحددها ويخطر بها
المشترى . كما يحدد القاضى كيفية إجراء البيع ، ويجوز له أن يأمر ببيع الأشياء القابلة
للتلف سريع دون تحديد مهلة أو إخطار .
٢ - على البائع إيداع حصيلة المبيع خزانة المحكمة حتى يسوى النزاع بينه وبين
المشترى إذا كان المشترى قد دفع الثمن بكامله .
