يكون الترشيح لعضوية المجلس بطلب يقدم من المرشح الى مجلس النقابة فى الميعاد الذى يحدده لقبول طلبات الترشيح على أن يكون قبل الموعد المحدد لاجراء الانتخاب بأربعين يوما على الأقل .
ويعد مجلس النقابة قائمة المرشحين خلال عشرة أيام على الأكثر من قفل باب الترشيح وتعلن على المحامين فى النقابات الفرعية ، ولمن أغفل ادراج اسمه بها أن يتظلم الى مجلس النقابة أو أن يطعن فى قراره أمام محكمة استئناف القاهرة خلال عشرة أيام من تاريخ نشر كشوف المرشحين ويفصل فى الطعن على وجه الاستعجال .
