لايعتبر حسن النية في حكم المواد السابقة من يعلم بالفعل أو كان في
مقدوره أن يعلم بحسب موقعه بالشركة أو علاقته بها بأوجه النقص أو العيب في
التصرف المراد التمسك به في مواجهة الشركة .
ولايعتبر الشخص عالما بمحتويات أية وثيقة أوعقد ، لمجرد نشرها
أو شهرها باحدى الوسائل المنصوص عليها في هذا القانون .
