يكون العقد الابتدائى للشركة ونظامها أو عقد تأسيسها رسميا أو مصدقا
على التوقيعات فيه ، ويجب أن يتضمن بالنسبة الى كل نوع من أنواع الشركات
البيانات التى تحددها اللائحة التنفيذية ، كما تحدد هذه اللائحة الاقرارات
والشهادات التى ترفق بعقد الشركة ، وكذلك أوضاع التصديق على التوقيعات
لدى الجهة الادارية المختصة .
