تخضع لأحكام هذا القانون صناديق التأمين الخاصة المسجلة لدى الهيئة في تاريخ العمل به ، كما تسرى أحكامه على صناديق التأمين الخاصة التي تبلغ قيمة مواردها السنوية مائة ألف جنيه فأكثر ، وبشرط ألا يقل عدد أعضائها عن مائة عضو .
ولصناديق التأمين الخاصة أن تعمل بنظام المزايا المحددة أو نظام الاشتراكات المحددة أو النظام المختلط .
