فى الأحوال التى يخصص فيها العقار بنظام بيع حق الانتفاع ويتم رهن هذا الحق ضمانا لتمويل المشروعات الخاضعة لأحكام هذا القانون ، فلا ينقضى هذا الحق إلا بانتهاء المدة المقررة له ولو توفى المنتفع أو زالت شخصيته الاعتبارية بحسب الأحوال .
