يبقى الرهن قائما لمصلحة الدائن المرتهن ولو تقرر بطلان عقد بيع حق الانتفاع أو فسخه أو زواله لأى سبب من الأسباب عدا انتهاء المدة المقررة له ما لم يتوافر علم الجهة مقدمة التمويل بسبب البطلان أو الفسخ عند إبرام عقد الرهن .
