إذا حضر الخصم الذى لم يقبل الأمر الجنائى فى الجلسة المحددة نظر الدعوى فى مواجهته وفقا للإجراءات العادية .
أما إذا لم يحضر تعود للأمر قوته ويصبح بمثابة حكم نهائى واجب التنفيذ .

إذا حضر الخصم الذى لم يقبل الأمر الجنائى فى الجلسة المحددة نظر الدعوى فى مواجهته وفقا للإجراءات العادية .
وللمحكمة أن تحكم فى حدود العقوبة المقررة بعقوبة أشد من الغرامة التى قضى بها الأمر الجنائى .
أما إذا لم يحضر تعود للأمر قوته ويصبح بمثابة حكم نهائى واجب التنفيذ .
