إذا تعدد المتهمون وصدر ضدهم أمر جنائى وقرروا عدم قبوله وحضر بعضهم فى اليوم المحدد لنظر الدعوى ولم يحضر البعض الآخر نظر الأمر الجنائى بالطرق المعتادة بالنسبة لمن حضر ويصبح الأمر نهائيا بالنسبة لمن لم يحضر .
