للنائب العام أن يلغي الأمر المذكور في مدة الثلاثة الأشهر التالية لصدوره ، ما لم يكن قد صدر قرار من مستشار الإحالة أو من محكمة الجنح المستأنفة منعقدة في غرفة المشورة ، حسب الأحوال ، برفض الطعن المرفوع عن هذا الأمر.
