لا يجوز للنيابة العامة فى التحقيق الذى تجريه تفتيش غير المتهم أو منزل غير المتهم أو ضبط الخطابات والرسائل فى الحالة المشار إليها فى الفقرة الثانية من المادة ٩١ إلا بناء على إذن من قاضى التحقيق .
