إذا لم تكن القسمة عينا ، أو كان من شأنها إحداث نقص كبير في المال المراد قسمته ، بيع هذا المال بالطريق المبينة في قانون المرافعات ، وتقتصر المزايدة على الشركاء إذا طلبوا هذا بالإجماع .
