Article 44 of the Civil and Commercial Procedure Law

لا يجوز أن يجمع المدعى فى دعوى الحيازة بينهما وبين المطالبة بالحق و إلا سقط ادعاؤه بالحيازة .
ولا يجوز أن يدفع المدعى عليه دعوى الحيازة بالاستناد إلى الحق ، ولا تقبل دعواه بالحق قبل الفصل فى دعوى الحيازة وتنفيذ الحكم الذى يصدر فيها إلا إذا تخلى بالفعل عن الحيازة لخصمه .
وكذلك لا يجوز الحكم فى دعاوى الحيازة على أساس ثبوت الحق أو نفيه .
