يجوز التظلم أمام المحكمة الاستئنافية من وصف الحكم وذلك بالإجراءات المعتادة لرفع الدعوى ويكون ميعاد الحضور ثلاثة أيام .
ويجوز إبداء هذا التظلم في الجلسة أثناء نظر الاستئناف المرفوع عن الحكم .
ويحكم في التظلم مستقلا عن الموضوع .
