يكون الاختصاص عند التنفيذ على المنقول لدى المدين لمحكمة التنفيذ التي يقع المنقول في دائرتها ، وفي حجز ما للمدين لدى الغير لمحكمة موطن المحجوز لديه .
ويكون الاختصاص عند التنفيذ على العقار للمحكمة التي يقع العقار في دائرتها فإذا تناول التنفيذ عقارات تقع في دوائر محاكم متعددة كان الاختصاص لإحداها .
